Obama In Notre Dame Speech Calls For 'Open Hearts, Open Minds' In Abortion-Rights Debate
In his address at the University of Notre Dame"s commencement ceremony on Sunday, President Obama urged advocates on both sides of the abortion-rights debate to treat each other with civility and find ways to work together on common goals, such as reducing the number of unintended pregnancies, the New York Times reports. Obama, who also received an honorary degree from the Roman Catholic university, called for more "open hearts, open minds, fair-minded words" on an issue that has long polarized the U.S. Obama said that although not all will agree on abortion rights, people "can still agree that this heart-wrenching decision for any woman is not made casually" and "has both moral and spiritual dimension." He continued, "So let us work together to reduce the number of women seeking abortions," by reducing unintended pregnancies, making "adoption more available," and providing "care and support" to women who carry pregnancies to term. Obama also said he supports a "sensible conscience clause" that would allow health care workers to withhold services they find morally or religiously objectionable, the New York Times reports. The president said that "[e]ach side will continue to make its case to the public with passion and conviction. But surely we can do so without reducing those with differing views to caricature" (Baker/Saulny, New York Times, 5/18).According to the Wall Street Journal, Notre Dame"s invitation to Obama "amplified longstanding tensions" between the Catholic Church"s position against abortion rights and Catholic universities" academic freedom. Several Catholic bishops and antiabortion-rights advocates argued that it was wrong to honor Obama because of his support for abortion rights, while the university"s leadership and others said it is necessary to communicate with people of opposing views (Meckler, Wall Street Journal, 5/18). Notre Dame"s president, the Rev. John Jenkins, in his introduction of Obama praised the president for agreeing to speak at the ceremony. He said that although some individuals "might have avoided this venue" because of the abortion issue, Obama "is not someone who stops talking to those who differ with him" (Evans, USA Today, 5/18). Jenkins also said, "If we want to extend courtesy, respect and love and enter into dialogue, then surely we can start by acknowledging what is honorable in others" (Dinan, Washington Times, 5/18).The New York Times reports that about 100 abortion-rights opponents protested on the edge of Notre Dame"s campus, and nearly 40 protesters were arrested trying to enter the campus (New York Times, 5/18). According to the Washington Post, more than 70 Catholic bishops criticized the university"s invitation, and more than 360,000 people signed a petition calling for the university to rescind the invite. The Post also reports that 26 of the 2,900 graduates chose to skip the commencement ceremony in protest of Obama"s speech (Shear, Washington Post, 5/18). However, the bulk of the audience at the ceremony "enthusiastically supported" the president, the New York Times reports. A few graduates pasted crosses and replicas of infants" feet on their mortarboards in protest of Obama"s visit, while some supporters displayed Obama"s campaign logo. Four protesters interrupted the speech with shouting and were removed by security guards; audience members responded to the shouting with Notre Dame chants and shouts of "Yes, we can," an Obama campaign slogan. The New York Times reports that while Obama has tried to avoid confrontation on the issue of abortion rights, the controversy over this Notre Dame speech and his pending nomination to replace retiring Supreme Court Justice David Souter have "pushed the issue to the forefront" (New York Times 5/18). Obama"s speech comes as his administration initiates its first meetings between advocates on both sides of the debate to discuss ways to reduce unintended pregnancies and the need for abortion. Supreme Court Rules Pensions Need Not Include Maternity Leave Taken Prior To Pregnancy Discrimination Act
The Supreme Court on Monday in a 7-2 decision ruled that employers are not required to award women credit toward pension benefits for maternity leave taken before Congress passed the 1978 Pregnancy Discrimination Act, which states that pregnancy should be treated like other temporary disabilities, the New York Times reports. The majority opinion stated that the 1978 law, which made pregnancy-related discrimination a form of sex discrimination, was not retroactive; therefore, employers were not required to adjust the pension calculations for these women. The case decided Monday -- AT&T v. Hulteen -- involved four women who had taken maternity leaves before 1978, when it was legal for employers to treat pregnancy leave differently from other types of disability leave. In the majority opinion, Justice David Souter wrote that the women are not entitled to full credit for their pregnancy leaves and will therefore receive smaller pensions, the Times reports. Souter was joined in the majority by Chief Justice John Roberts and Justices John Paul Stevens, Antonin Scalia, Anthony Kennedy, Clarence Thomas and Samuel Alito. Justices Ruth Bader Ginsburg and Stephen Breyer dissented. Souter"s ruling was based in great part on a 1976 Supreme Court ruling, General Electric v. Gilbert, which found that policies treating pregnancy leave worse than other types of disability leaves did not amount to sex discrimination (Liptak, New York Times, 5/19). Congress swiftly overruled Gilbert by passing the Pregnancy Discrimination Act (Egelko, San Francisco Chronicle, 5/19). Ginsburg in the dissent wrote that the court had "erred egregiously" in Gilbert, which she said advanced the "strange notion that a benefits classification excluding" pregnant women is not based on sex "because other women are among the favored class ("non-pregnant persons")." Ginsburg said that in passing the Pregnancy Discrimination Act, Congress did not intend to continue reducing women"s compensation, including pension benefits, "attributable to their placement on pregnancy leave," adding that the women involved in the case will receive smaller pensions than their colleagues for the rest of their lives (New York Times, 5/19). "[A]ttitudes about pregnancy and childbirth ... have sustained pervasive, often law-sanctioned, restrictions on a woman"s place among paid workers and active citizens," Ginsburg said (Biskupic, USA Today, 5/19).ImpactJudith Kurtz, a plaintiffs" attorney in the case, said the ruling will affect thousands of women across the country, nearly all of them in the telecommunications industry. Debra Ness, president of the National Partnership for Women and Families, said that the decision is "a painful and serious blow to America"s working women and the families who rely on their retirement benefits" (San Francisco Chronicle, 5/19). Ness said that the decision "forces women to pay a high price today because their employers discriminated yesterday" (Holland, AP/Google.com, 5/18). She added, "In the current economic climate, women and their families cannot afford to see their retirement benefits kept lower by discriminatory workplace policies that should have been remedied decades ago" (Mears, CNN.com, 5/18). Some women"s rights advocates said the ruling is comparable to the pay discrimination decision against Lilly Ledbetter in 2007. Marcia Greenberger of the National Women"s Law Center said the decision was "an all-too-timely reminder of the importance of having on the Supreme Court justices who understand the real-world impact of the law" (Savage, Los Angeles Times, 5/19).

Senator Boxer Introduces Legislation To Address Nationwide Nursing Shortage

U.S. Senator Barbara Boxer (D-CA) introduced the National Nursing Reform and Patient Advocacy Act, legislation to protect the rights of nurses to advocate on behalf of their patients, set minimum nurse-to-patient ratios in hospitals, and invest in training nurses to address the current nationwide nursing shortage. "We cannot guarantee high-quality health care to every American without a high-quality workforce of nurses to provide it," Senator Boxer said. "That is why I am proud to introduce legislation to help address our nationwide shortage of nurses. By investing in our nurses, we can help improve the quality of care in our nation"s hospitals and save the lives of countless patients." The legislation builds on the success of California"s historic law that set registered nurse-to-patient ratios. The bill would extend the minimum standards in place in California hospitals to all general and long term care hospitals. Specifically, the bill would: - Establish specific nurse-to-patient ratios that will not only save lives and improve the quality of care, but also encourage more nurses to enter and stay in the workforce, which could help ease the nursing shortage. - Provide whistleblower protections to protect the right of nurses to advocate for the safety of patients and report violations of minimum standards of care. - Create a standard for helping nurses to lift patients to prevent on-the-job injuries and promote better quality patient care. The bill also creates a Registered Nurse Workforce Initiative within the Health Res and Services Administration that invests in the education of nurses and nursing faculty. The initiative provides grants for: - Nursing educational assistance and living stipends for nursing students who agree to work for at least 3 years for a safety-net health care provider. - Graduate educational assistance for registered nurses who commit to serve as nurse educators for at least 5 years at an accredited nursing program. - Training and mentorship demonstration projects.
